The Court reasoned that only Florida’s state Legislature can pass traffic laws. The ruling means that the city can regulate traffic issues of local concern, such as parking, but not red light controlled intersections.
Cities across Florida have tried to claim that a code violation is not the same as a traffic citation and that they have jurisdiction to create such rules. The court’s ruling, if it withstands appeal means that an officer must be present to enforce red-light violations.
